  • Attempt to gain unauthorised access to our systems
  • Interfere with the operation or security of the website
  • Copy, reproduce or commercially exploit our website content without permission
  • Upload malicious software, viruses or harmful material
  • Use automated systems to scrape or collect our content without permission
  • Provide false or misleading information when placing an order

We reserve the right to restrict or terminate access where there is a legitimate reason to do so, subject to applicable law.

3. Products

We make reasonable efforts to ensure that product descriptions, photographs, colours, sizes and specifications displayed on our website are accurate.

However, colours may appear slightly different depending on your device, screen settings or lighting conditions.

Product images may also be illustrative where indicated.

Where a product has specific specifications, measurements or care instructions, customers should review the relevant product information before ordering.

Nothing in these Terms limits any rights you may have under the Consumer Protection Act regarding goods that do not conform to the agreement or applicable quality requirements.

4. Product Availability

All products are subject to availability.

If an item becomes unavailable after you place an order, we will contact you and, where applicable, offer an appropriate solution such as:

  • A replacement product
  • An alternative product
  • A refund

We will not intentionally accept payment for goods that we know we cannot supply.

5. Prices

All prices displayed on our website are stated in South African Rand (ZAR) unless otherwise indicated.

The applicable price is the price displayed at the time you place your order.

Where applicable, prices will include VAT and other charges required to be disclosed by law.

Any applicable delivery or other additional charges will be disclosed before you complete your purchase.

For electronic transactions, South African law requires online suppliers to provide consumers with information including the full price and applicable transport, taxes and other costs.

6. Orders

When you place an order, you are making an offer to purchase the selected products.

You will receive an order confirmation once your order has been received.

An order may be cancelled or adjusted where reasonably necessary, including where:

  • A product is unavailable
  • There has been an obvious pricing or product-description error
  • There is suspected fraudulent activity
  • We are unable to fulfil the order for reasons beyond our reasonable control

Where an order is cancelled after payment has been received, any refund due will be processed in accordance with applicable law and our Refund Policy.

7. Payment

We accept the payment methods displayed on our website at checkout.

Payments may be processed by third-party payment providers.

We do not ordinarily receive or store your full payment-card details where payment is processed securely by a third-party payment provider.

You agree to provide accurate payment and billing information.

We reserve the right to verify transactions where reasonably necessary to prevent fraud or unauthorised transactions.

8. Delivery

We deliver to locations within South Africa where our delivery service is available.

Estimated delivery times will be communicated during the ordering process or through our delivery information.

Delivery times are estimates and may be affected by circumstances outside our reasonable control, including:

  • Courier delays
  • Severe weather
  • Public holidays
  • Address problems
  • Unforeseen logistical disruptions
  • Events beyond our reasonable control

We will make reasonable efforts to keep customers informed of significant delivery delays.

Where applicable, consumers will be provided with information concerning the expected delivery period before completing an electronic transaction.

9. Delivery Address

Customers are responsible for providing a complete and accurate delivery address.

If an incorrect address is provided and the courier is unable to deliver the order as a result, additional delivery charges may apply where permitted by law.

Please contact us as soon as possible if you realise that your delivery details are incorrect.

10. Risk and Delivery

We will take reasonable steps to ensure that your order is properly packaged and dispatched.

Nothing in these Terms is intended to exclude or limit any rights or protections that cannot lawfully be excluded under South African consumer-protection legislation.

11. Returns, Exchanges & Refunds

Our Returns & Refunds Policy forms part of these Terms.

You can view our full policy here:

https://yogaflex4u.com/policies/refund-policy

Our policy covers:

  • Change-of-mind returns
  • Online cooling-off rights where applicable
  • Incorrect products
  • Damaged products
  • Defective products
  • Exchanges
  • Refunds
  • Return shipping

Nothing in our Returns & Refunds Policy or these Terms is intended to remove or restrict any mandatory rights available to consumers under South African law.

The CPA prohibits terms that attempt to waive or deprive consumers of statutory rights or impose unfair or unreasonable terms.

12. Activewear & Hygiene

For health and hygiene reasons, customers should not wear or wash activewear before deciding whether to keep it.

For voluntary change-of-mind returns, products may need to be unused, unworn, clean and in their original condition.

This does not affect statutory rights relating to defective, unsafe or non-conforming goods.

Please refer to our Returns & Refunds Policy for the full requirements.

13. Defective Products

If you believe that a product is defective or does not meet applicable legal requirements, please contact us.

Depending on the circumstances, consumers may have statutory remedies under the CPA, including repair, replacement or refund.

The CPA provides consumer protections concerning defective, unsafe or poor-quality goods.

Please provide your order number and photographs where appropriate so that we can investigate the issue.

14. Promotions & Discount Codes

From time to time, we may offer promotional codes, discounts or special offers.

Unless otherwise stated:

  • Promotional codes cannot be exchanged for cash
  • Only one promotional code may be used per order
  • Promotions may have specific terms and expiry dates
  • Promotional offers may be subject to stock availability

We will clearly communicate any material conditions attached to promotions.

Nothing in a promotion will limit rights granted to consumers by applicable law.

15. Intellectual Property

The website may occasionally be unavailable because of maintenance, technical issues or circumstances outside our reasonable control.

20. Third-Party Services

Our website may use third-party services, including:

  • Payment providers
  • Courier companies
  • Website hosting providers
  • Analytics services
  • Marketing platforms
  • Social-media platforms

Third-party services may have their own terms and privacy policies.

We are not responsible for matters solely within the control of an independent third-party provider, subject to your rights under applicable law.

21. Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, these Terms do not exclude or limit:

  • Rights granted to consumers under the CPA
  • Liability that cannot lawfully be excluded
  • Liability for gross negligence where exclusion is prohibited
  • Any other statutory rights or remedies that cannot legally be waived

The CPA specifically restricts terms that attempt to exclude certain supplier liabilities or deprive consumers of statutory rights.

22. Indemnity

To the extent permitted by law, you agree to be responsible for losses or claims arising from your unlawful or unauthorised use of our website or your violation of these Terms.

This clause does not require you to accept liability for matters for which the law does not permit such liability to be imposed.

23. Changes to These Terms

We may update these Terms from time to time to reflect:

  • Changes to our business
  • Changes to our products or services
  • Changes to applicable law
  • Changes to website functionality

The latest version will be published on our website.

Please provide your order number and a clear description of the issue.

We will make reasonable efforts to resolve complaints promptly and fairly.

Where a dispute cannot be resolved directly, consumers may have access to applicable statutory complaint or dispute-resolution mechanisms.

25. Governing Law

These Terms are governed by the laws of the Republic of South Africa.

Any dispute will be dealt with in accordance with applicable South African law, subject to any mandatory consumer rights or jurisdictional protections available to the consumer.

26. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be treated as severable to the extent necessary.

The remaining provisions will continue to apply to the extent permitted by law.

27. Entire Agreement

These Terms, together with our:

  • Returns & Refunds Policy
  • Privacy Policy
  • Delivery Policy
  • Any applicable promotion terms

form the terms governing your use of our website and purchases from our store, subject to applicable South African law.
